§ 10-35. Nuisance dogs.

  • (a)

    It shall be unlawful for an owner to keep or maintain a dog in the city which causes any annoyance to persons in the neighborhood or in the proximity of such dog by frequent or habitual barking or howling (including sounds of a loud or disturbing nature) or which frequently threatens to attack or bite or does bite.

    (b)

    Vicious dogs shall at all times be kept within suitable enclosures which would prevent the escape of such animal, or shall be kept under the physical control of a competent person. No such dog shall be allowed to roam outside, even upon the property of the owner, such that the public safety is compromised or which would prevent persons such as utility personnel, letter carriers (or other delivery personnel), or any such other person as may come upon the property for lawfully recognized purposes.

    (c)

    It shall be unlawful for any owner to keep or maintain a dog within the city limits which destroys or damages the property of others.

    (d)

    In the event any dog is found to have damaged or destroyed property not the property of the owner of such dog, such owner of the dog shall be subject to the penalties provided by section 1-13 of this Code, providing for a fine not exceeding $500.00 or imprisonment for a term not exceeding 60 days, or both, together with any other penalty applicable under this division.
