§ 26-51. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Adjacent lot means the lot immediately adjoining or contiguous to or abutting the right-of-way immediately opposite the lot that is subject to review under this article.

    Building means any structure as defined with the Standard Building Code, section 201.2 adopted in section 18-36. The term "building" includes the term "structure."

    Natural state means a vacant lot that has never been cleared or has not been maintained for a period of three years or more.

    Nuisance. Every condition or activity in the city which is offensive or prejudicial to the health or general welfare of the residents shall be deemed to be a nuisance and, where not so specified by law or ordinance, the code enforcement officer shall have the power and authority to determine that an activity or condition constitutes a nuisance as defined herein.

    Owner means the owner of record of a lot as such appears in the official records of the clerk of the circuit court for the county.

    Rubble and debris means waste materials resulting from the construction or demolition of structures or buildings not usable as a part of or for the construction or demolition of structures or buildings.

    Sanitary nuisance means the commission of any act by an individual, organization, or corporation, or the keeping, maintaining propagation, existence or permission of anything by an individual, organization or corporation, by which the health or life of an individual, or the health or lives of individuals, may be threatened or impaired, or by which or through which, directly or indirectly, disease may be caused.

    Waste means:

    (1)

    Garbage, rubbish and refuse from residential, commercial or industrial activities, including kitchen and table food waste, animal or vegetable waste that is attendant with or results from the storage, preparation, cooking or handling of food material;

    (2)

    Paper, wood scraps, cardboard, cloth, glass, rubber, plastic;

    (3)

    Discarded vehicles, tires or vehicle parts or fixtures;

    (4)

    Household goods, furniture or appliances;

    (5)

    Toys;

    (6)

    Tools or equipments; and

    (7)

    Any similar materials.
